Terms and Conditions
1. Acceptance and Website Use
These Terms and Conditions regulate access to netdelsol.com and the services presented under the commercial name Net Del Sol, operated by A. William Kozman, with contact email info@netdelsol.com. By browsing the website, submitting a form, requesting information, asking for a quotation or demo, or communicating with Net Del Sol, the user agrees to use the website and its services lawfully, respectfully, responsibly, and without any intention to cause harm, misuse resources, or affect other users in any way.
2. Services Presented by Net Del Sol
Net Del Sol provides digital and technical services including website design and redesign, PHP/MySQL development, custom software, property software solutions, online shopping cart support, hosting and domain guidance, company branding, SEO, video and email marketing, after-sale services, maintenance support, quotations, online inquiries, and demo or free-trial requests. No website text, package description, demo page, visual design, or online form becomes binding unless Net Del Sol confirms the terms in writing.
3. Quotations and Project Confirmation
Any quotation, proposal, demo, trial, package, delivery estimate, technical recommendation, price indication, or project suggestion from Net Del Sol is based on the information available at the time. Final scope, price, delivery time, features, support terms, payment schedule, and responsibilities must be confirmed in a written proposal, invoice, contract, or accepted agreement. Net Del Sol may refuse, suspend, or revise work that is unlawful, abusive, unsafe, outside scope, missing materials, or professionally unsuitable.
4. Client Responsibilities
The client is responsible for providing accurate information, legal content, access credentials, brand materials, images, product data, business details, hosting and domain information, third-party licenses, and approvals needed to complete the work. Net Del Sol is not responsible for delays, incomplete delivery, technical limits, content errors, provider restrictions, hosting or domain issues, payment-gateway limits, plugin conflicts, or interruptions caused by missing data, wrong instructions, expired accounts, or third-party decisions.
5. Ownership and Usage Rights
All original designs, layouts, graphics, interface concepts, icons, written content, code, software structures, database designs, documentation, demos, prototypes, source files, prompts, project plans, visual compositions, and technical solutions created by Net Del Sol remain protected intellectual property unless a written agreement states otherwise. Payment for a project does not automatically transfer all source materials, reusable components, internal tools, frameworks, templates, systems, or methods, only the agreed usage rights.
6. Anti-Piracy and Copyright Protection
Users and clients may not copy, clone, resell, redistribute, reverse-engineer, extract, imitate, scrape, reproduce, publish, modify, or reuse Net Del Sol’s website design, software code, database structure, visual identity, project documents, demo systems, images, icons, prompts, templates, or custom technical solutions without written authorization. Any attempt to pirate, duplicate, commercialize, or pass Net Del Sol’s work as another party’s work is prohibited, and may be challenged through legal or technical measures.
7. Payments, Scope, and Demo Access
Unless otherwise agreed in writing, all payments, deposits, staged payments, renewal fees, hosting-related fees, maintenance fees, third-party licenses, and additional work must be paid according to the accepted proposal or invoice. Work outside the approved scope may require a new quotation or written approval before implementation. Demo access, free trials, consultations, or advice may be limited in duration, functionality, confidentiality, and availability, and may be withdrawn if misused, copied, or shared without permission.
8. Governing Law and Updates
These Terms and Conditions are governed by Spanish law and applicable European regulations. If any part is found invalid or unenforceable, the remaining provisions shall continue to apply. Net Del Sol may update these Terms when services, technology, legal duties, pricing, or business operations change. Any dispute shall first be addressed in good faith through direct communication, and where legally permitted, submitted to the competent courts linked to the owner’s registered address, without prejudice to mandatory consumer rights.
